Terms and Conditions

Introduction
These Terms and Conditions govern the use of all services provided by Blue Falon Real Estate Valuation LLC, including real estate consultancy, valuation, and brokerage for the purchase and sale of properties. By engaging with the Company, whether through written agreement, electronic confirmation, or verbal confirmation, the Client accepts these Terms in full. If the Client does not agree, they must refrain from using the Company’s services.
Scope of Application
The Terms apply to all engagements between the Company and the Client. They extend to consultancy assignments, valuation reports, brokerage transactions, and any other related services offered by the Company. The Terms apply regardless of whether the service is delivered in person, by electronic communication, or by telephone, unless expressly replaced by a separate written agreement signed by both parties.
Definitions
For the purpose of these Terms, “Services” refers to all consultancy, property valuation, and brokerage services offered by the Company. “Client” refers to any person or legal entity engaging the Company for Services. “Valuation Report” refers to a written opinion of the value of a property prepared by the Company in accordance with applicable professional standards. “Fees” refers to the charges payable by the Client in consideration of the Services provided.
Formation of Contract
A contract between the Company and the Client is deemed to be formed when the Client provides confirmation to proceed with the Services. Such confirmation may be provided in writing, electronically, or verbally. Verbal confirmation shall be treated as equally binding as written confirmation for the purposes of these Terms. Once confirmation is provided, the Client is obligated to make full payment of the Fees in advance, after which the Company will commence performance of the Services.
Services
The Company provides professional consultancy on the real estate market, including guidance on investments and property strategies. The Company also provides professional property valuation reports for use in financing, legal, regulatory, or investment contexts. Additionally, the Company acts as an intermediary in the purchase and sale of properties, in full compliance with applicable laws and regulations of the Real Estate Regulatory Agency (RERA) and the Dubai Land Department.
Responsibilities of the Parties
The Company undertakes to deliver the Services with due professional skill, care, and diligence, in accordance with applicable laws, regulations, and recognized professional standards. The Company shall maintain confidentiality in relation to all non-public information provided by the Client, unless disclosure is required by law or regulatory authorities. The Client undertakes to provide complete, accurate, and timely information relevant to the Services. The Client is responsible for disclosing all material facts relating to the property or transaction in question. The Client acknowledges that reliance on incomplete or inaccurate information may affect the outcome of the Services and shall not give rise to liability on the part of the Company.
Fees and Payment Terms
The Client agrees to pay the full amount of the Fees prior to the commencement of the Services. Payment must be made in advance and in full, with no exceptions. Payment may be made in United Arab Emirates Dirhams (AED) or United States Dollars (USD). All charges, deductions, conversion costs, bank fees, or other expenses incurred in the process of making payment are to be borne solely by the Client, and the Company must receive the full invoiced amount without deduction.
Intellectual Property and Rights of Use
All intellectual property rights in reports, analyses, valuations, and other documents or materials prepared by the Company remain the exclusive property of the Company. The Client is granted a limited right to use such materials solely for the specific purpose for which they were provided. The Client may not reproduce, distribute, or disclose such materials to third parties without the prior written consent of the Company, except where disclosure is required by law or regulatory authorities.
Confidentiality
The Company and the Client each undertake to maintain strict confidentiality with respect to all confidential and non-public information exchanged in the course of the Services. This obligation shall survive termination of the contract, except in cases where disclosure is required by law or court order, or where information has already entered the public domain through no fault of the receiving party.
Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages resulting from the use of its Services. Liability for any claim arising from or in connection with the Services shall be strictly limited to the amount of Fees paid by the Client for the specific Service giving rise to the claim. The Client acknowledges and agrees that property valuations are professional opinions based on information available at the time of assessment and subject to prevailing market conditions, and that the Company does not provide any guarantee of future value, investment performance, or market outcome.
Compliance with Laws
The Client agrees to use the Services in full compliance with the applicable laws and regulations of the United Arab Emirates, including those of the Dubai Land Department and the Real Estate Regulatory Agency.
Termination
Either party may terminate the agreement by written notice if the other party is in material breach of these Terms and fails to remedy such breach within a reasonable period after notice is given. Upon termination, the Client shall remain liable for payment of all Services rendered up to the date of termination. No refunds shall be made for Services already performed.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.

Data Protection and Data Processing Policy

This Data Protection and Data Processing Policy outlines the principles under which personal data is collected, processed, stored, and disclosed in compliance with applicable data protection laws of the United Arab Emirates.
Data Controller and Data Processor
For the purposes of applicable laws, the Company acts as the Data Controller when determining the purposes and means of processing personal data, and may act as a Data Processor when handling personal data on behalf of clients, partners, or regulatory authorities. In both roles, the Company is committed to ensuring compliance with data protection principles.
Purpose and Basis of Processing

Principles of Data Protection
The Company shall ensure that all personal data is:

  • Accurate and kept up to date, with all reasonable steps taken to rectify inaccurate data without delay.
